These Terms of Service ("Terms") govern your access to and use of the KittyBoom.ai platform, including our website at kittyboom.ai, our Chrome browser extension, AI chat service, and any related software or services (collectively, the "Service"), operated by Azerothia Digital LLC ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

2. Eligibility

To use the Service, you must satisfy all of the following conditions:

  • You are at least 18 years of age (we may request proof of age at any time)
  • You have the legal capacity to enter into a binding agreement
  • You are not located in a jurisdiction subject to government sanctions or designated as a terrorist-supporting country
  • You are not on any prohibited or restricted party list maintained by the United States or European Union

3. Account Registration

You may be required to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

6. Subscription and Payments

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees as described on our pricing page. Subscriptions automatically renew unless cancelled before the end of the current billing period.

All fees are non-refundable except as required by law or as explicitly stated in our 30-day money-back guarantee for first-time subscribers. We reserve the right to change pricing with 30 days' notice.

Payment processing is handled by Stripe, Inc. Your payment information is subject to Stripe's terms and privacy policy.

7. Free Trial

We may offer a free trial period for new users. At the end of the trial, your access to paid features will be suspended unless you subscribe. We reserve the right to modify or discontinue free trials at any time.

Content generated by our AI features is provided as suggestions only. You are solely responsible for reviewing, editing, and using any AI-generated content. We make no warranties regarding the accuracy, appropriateness, or legal compliance of AI-generated content.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. We may access and disclose your information when required by law, to enforce these Terms, to detect fraud or security issues, or to protect the rights and safety of our users.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not endorse any content or advertisements displayed through third-party integrations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZEROTHIA DIGITAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR REPUTATION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE THOUSAND US DOLLARS (USD $1,000).

13. Indemnification

You agree to defend, indemnify, and hold harmless Azerothia Digital LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, you must immediately cease all use of the Service. Sections 8, 9, 11, 12, 13, 15, and 16 shall survive termination.

16. General Provisions

  • Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
  • Dispute Resolution: Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.
  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Azerothia Digital LLC regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.
  • No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent.
